These Terms of Service (“Terms”) govern your access to and use of the Warsha mobile application, website, and related services (collectively, the “Platform”). By creating an account or using Warsha, you agree to these Terms and our Privacy Policy (DRAFT).
1. Who operates Warsha

2. What Warsha is (and is not)
Warsha is a marketplace platform that connects buyers, shops (suppliers), and delivery partners for building materials and related products in Lebanon.
- Warsha is not the seller of products listed by shops. The shop you order from is the seller of record for product quality, description, and fulfillment obligations, subject to applicable law.
- Warsha is not a delivery company unless we explicitly say otherwise. Delivery partners are independent participants who accept jobs through the Platform.
- Warsha provides listing, ordering, messaging, and coordination tools. We may update features over time.
3. Roles & eligibility
- Buyers — browse, purchase, and receive deliveries.
- Shop owners — list products, manage catalog, and fulfill orders.
- Delivery partners — claim and deliver orders.
- Admins — internal Warsha operators (not available at public signup).
You must be able to form a binding contract under Lebanese law and provide accurate registration information. You are responsible for activity under your account.
4. Anti-scam & acceptable use
When you create an account, you also accept Warsha’s in-app anti-scam agreement, including that you will:
- Provide accurate identity information when requested
- Not use stolen payment methods, fake credentials, or fraudulent delivery claims
- Resolve delivery disputes through the in-app process before escalating
- Treat buyers, shop owners, and delivery personnel with respect
You may not misuse the Platform, interfere with other users, scrape data, upload malware, or circumvent security. We may suspend or terminate accounts that violate these Terms, our policies, or applicable law, with or without notice where permitted.
5. Orders, shops & delivery
- Product descriptions, prices, stock, and availability are set by shops.
- Order status updates (confirmed, ready for delivery, out for delivery, delivered) are shown in the app.
- Delivery addresses and map pins you provide must be accurate.
- Shops and delivery partners may see information necessary to fulfill your order.
6. Payments — cash on delivery
Today, Warsha supports cash on delivery (COD) only. You pay the delivery driver in cash when materials arrive. Warsha does not currently process card or wallet payments in the live checkout flow.
When we add payment partners (for example Whish, OMT, or cards) in the future, separate terms and checkout flows may apply. This draft will be updated before those methods go live.
7. Refunds & disputes
Refund and return rules for COD orders are described in our Refund & Returns Policy (DRAFT). Complaints should be raised within [COMPLAINT_WINDOW]. Responsibility for refunds may be allocated as [WHO_REFUNDS] (to be confirmed with counsel).
8. Content & intellectual property
- Warsha owns the Platform software, branding, and design.
- Shops retain ownership of photos and catalog content they upload, but grant Warsha a licence to display and promote listings on the Platform.
- You may not copy or reuse Platform content without permission.
Shop and delivery partner commercial terms may also be governed by our Master Services Agreement (DRAFT).
9. Disclaimers
The Platform is provided “as is” and “as available” to the fullest extent permitted by law. Warsha does not guarantee uninterrupted service, error-free listings, or that every shop or driver will meet your expectations. Building-material purchases involve weight, safety, and suitability decisions that remain your responsibility.
10. Limitation of liability
To the fullest extent permitted by Lebanese law, Warsha and its operators are not liable for indirect, incidental, special, or consequential damages, or for product defects, delivery delays, or disputes between buyers, shops, and delivery partners — except where liability cannot be excluded by law. Specific caps and carve-outs: [to be confirmed with counsel].
Cyber insurance coverage is to be arranged with a broker and is not in place as of this draft.
11. Privacy
Our collection and use of personal data is described in the Privacy Policy (DRAFT). Account deletion is described on Data deletion.
12. Governing law & disputes
These Terms are governed by the laws of Lebanon, without regard to conflict-of-law rules. Courts or forums of [GOVERNING_COURTS] shall have exclusive jurisdiction, subject to mandatory consumer protections under applicable law.
13. Changes
We may update these Terms. The “Last updated” date will change when we do. Material changes may be notified in the app or by email where appropriate. Continued use after an update constitutes acceptance, subject to applicable law.
